Craft Beer Business News: Brooklyn Brewery Files Suit Against Black Ops Brewing For Trademark Infringement

A complaint was filed Monday in California Eastern District Court on behalf of The Brooklyn Brewery Corporation against Black Ops Brewing, Inc. of Fresno, CA. Trademark infringement was sited as cause for the case. Presumably, the trademark in question is the one that Brooklyn Brewery has for their famous, once-a-year imperial stout release, Black Ops.

The complaint listed on the court docket is for: Trademark Infringement, False Designation of Origin, Unfair Competition and Passing Off against Black Ops Brewing, Inc. by The Brooklyn Brewery Corporation.

The first event in the case is scheduled for January 19, 2016.

    I agree with Brooklyn here, Black Ops is a patented name and special release for them. The other brewery applied for the patent and was denied, but still use the name. It sucks, but do a little research before naming your brewery!

    It should’ve been an easy one for soon-to-be-something-else Black Ops Brewery. Who in the beer world doesn’t know that release?
